TAMPA, FL – A Florida woman who claimed to be a victim of abuse yet was sentenced to 20 years behind bars for allegedly firing a warning shot during a dispute with her husband was granted a new trial Thursday.

The appellate court ruling erased a decision by a jury that took just 12 minutes to convict Marissa Alexander, a mother of three, of aggravated assault.

The conviction of Alexander, who is black, sparked outrage and cries of a racial double standard in light of the exoneration of George Zimmerman, a white Hispanic, for the death of Trayvon Martin, who was black.

In particular, outrage aired on social media and among some lawmakers on Capitol Hill.

Alexander unsuccessfully tried to invoke Florida’s “Stand Your Ground” law as the same prosecutors who unsuccessfully worked to put Zimmerman behind bars told the court that she did not act in self-defense.

In granting the new trial, Judge James H. Daniel also seemed unmoved by the Stand Your Ground defense.

“We reject her contention that the trial court erred in declining to grant her immunity from prosecution under Florida’s Stand Your Ground law, but we remand for a new trial because the jury instructions on self-defense were erroneous,” wrote Daniel.

Alexander testified that, on Aug. 1, 2010, her then-husband, Rico Gray Sr., questioned her fidelity and the paternity of her 1-week-old child.

She claimed that he broke through a bathroom door that she had locked and grabbed her by the neck.

She said she tried to push past him but he shoved her into the door, sparking a struggle that felt like an “eternity.”

Afterwards, she claimed that she ran to the garage and tried to leave but was unable to open the garage door, so she retrieved a gun, which she legally owned.

Once inside, she claimed, her husband saw the gun and charged at her “in a rage” saying, “Bitch, I’ll kill you.”

She said she raised the gun and fired a warning shot into the air because it was the “lesser of two evils.”

The jury rejected the self-defense claim and Alexander was sentenced under the state’s 10-20-life law, sparking outrage over how self-defense laws are applied in the state.

A Florida appellate court ruled today that jury instructions, which unfairly made Alexander prove “beyond a reasonable doubt” that she was acting in self-defense, were wrong — and that there were other incorrect instructions that self-defense only applied if the victim suffered an injury, which Gray had not.

Today, U.S. Rep. Corrine Brown, D-Fla., lashed out at Florida State Attorney Angela Corey, who oversaw the failed prosecution of George Zimmerman and the prosecution in this case, saying, “Arresting and prosecuting her when no one was hurt does not make any sense. … What was certainly absent from the courtroom during Marissa’s trial was mercy and justice. Indeed, the three-year plea deal from State Attorney Angela Corey is not mercy, and a mandatory 20-year sentence is not justice.”

Corey’s office argued that Alexander, who had not been living in the home for two months leading up to the shooting, provoked the incident, and that there was no proof the garage door was broken, Alexander’s rationale for not leaving the altercation.

Her office offered her a three-year plea deal in the case that was rejected.

Alexander testified about three other alleged incidents of physical abuse by her husband, including one that led to his arrest.

Several witnesses claimed to have seen the injuries she allegedly suffered and the final defense witness in the case testified that she met the criteria for “battered person’s syndrome.”

In a statement, prosecutors wrote, “The defendant’s conviction was reversed on a legal technicality. … We are gratified that the court affirmed the defendant’s Stand Your Ground ruling. This means the defendant will not have another Stand Your Ground hearing. The case will be back in the Circuit Court in the Fourth Judicial Circuit at the appropriate time.”

        It’s never a good thing to advocate for violence, particularly for the death of another human being, but I do see your point. I do, however, disagree with the fact that she might be free had she killed her abusive husband. We have to remember that she is a Black woman who resides in Florida, a state who has successfully given us a look into yesteryear in regard to rights, who has them, who doesn’t and how they can create and pass a law and work it to the disadvantage of minorities. Most likely she would be facing death at the hands of the state just because she tried to avoid death at the hands of her abusive husband. Either way its a terrible miscarriage of justice and she definitely shouldn’t have spent one night in jail. In short, “Stand Your Ground” laws in Florida are only meant to justify self defense if you’re a White male so the courts can move for acquittal. If the person on trial is a White female, or either gender of any other race, this law DOES NOT APPLY!!! Furthermore, I’m willing to bet had a good samaritan (who just happened to be a White male) was to see the violence perpetrated by her husband and intervened, killing the husband, she would still be held liable by the courts even though the good samaritan would have been acquitted. It’s not fair, but unfortunately, it is Florida.

    I guess some positive did come out of Zimmerman being acquitted, if Zimmerman gets locked up I doubt she gets another trial. Now they should look at Michael Giles case, his case has something to do with the same stuff, resident of Florida, invoking self-defense.

      I agree Bill, and there are too many inconsistencies in how they use their laws. I had no idea that FL has the same 10-20-Life law as they do here in CA. But why did they not apply this to George Zimmerman as well? And what exactly was the reason that Ms. Alexander was not able to use,the Stand Your Ground law as a defense to protect herself? She was threatened with being beaten up and was just trying to protect herself. Should she have initiated an action against her then husband, injure or kill him with the gun, then use it as self dense as in the case with Zimmerman? It’s sad to say, but it wouldn’t have worked with her mainly because she is a person of color, and we all know that, along with the man who shot his young wife’s lover, you have to be White in order to use that law successfully……and walk!!

        She was not allowed to use stand your ground because she did not stand her ground. She fled the situation, got a weapon, and then came back and fired. And she fired at him and it was no warning shot.
        And Zimmerman used self defense not SYG as his defense

    The media has portrayed Marissa to be such a wonderful person, but have neglected to reveal what the actual court documents revealed. The story Marissa made up about being beaten that day was a lie. She had just recently given birth to a little girl days before this incident took place. She returned back to the home of Rico Gray where she had not lived for two months prior. She spent the night in the home and waited for Rico to return home, which he did the following morning with his two sons. An argument broke out between the two, because of text messages Marissa had been sending to her first ex-husband (whose name she still carries/carried) regarding the newborn she had just has with Rico. There was no evidence to prove that on that day she was battered. Marissa has also been arrested for violating an injunction Rico had in place. Marissa went to his home and punched him in his eye. That very same day she claimed self defense and again that wasn’t proven. Marissa has a very bad attitude. This is a case where her bad attitude and actions have caught up with her. She still isn’t able to claim stand your ground, and there was no proof of her being beaten that day. I’m not sure what makes her exempt from her actions, but in this case I feel as if the justice was served properly. I’m sure the courts and her supporters will find some kind of loop hole in the system to get her off of her 20 year sentence. I bet she wishes she had never left her first husband for Rico now.

        Where you there to witness the happenings with your own eyes or are you assuming what you’ve heard/read in the media to be true? Perhaps you missed the fact that her husband had previously been arrested for alterations with his wife during your extensive research of the case. Help me understand why you deem yourself qualified enough to slander Mrs. Alexander by calling her a liar?

        I hardly think 20 years for firing a warning shot equates to justice. I guess we all have our own opinion! ;)

      yeah this version seems legit, but I have to say 20 yrs for shooting in the air is rather extreme and one could say unconstitutional, If your story of what happened that night is true than a far lighter sentence is in order such as probation since she did legally own that gun and there is no actual proof here nor there to say either was the aggressor

      Um, Qui…I’m assuming you rarely keep up with CNN. Legal documents from the former prosecutors (her abuser) mentioned if given the chance he would have taken the gun and shot her himself. Also, he proudly mentioned verbally that he “beats 4 out of his 5 baby mamas” and has no regrets about that.

      However, her self defense was thrown out AND he received custody of their young daughter. Educate yourself before you sound like a jackass.

        The 20 years is a mandatory sentence, the judge legally could not giver her any less, she rejected a plea offer of 3 years, obviously her husband is a scumbag coward but it was her own actions that landed her in prison by going TO HIS house and punching him in the face, they both had a history of violence against each other.

        George Zimmerman is not white, if that’s who you are referring to. And according to the law, he was not guilty, no matter how disgusting you or I think that is. I get so damn sick of blacks screaming they are persecuted. I get so tired of hearing that whites don’t suffer the same consequences. Marissa Alexander did not deserve 20 years for an over the head shot fired in Florida. Jeffrey Havard did not deserve a death sentence for an accident in Mississippi. One is black, one is white. Marissa Alexander is getting a second trial and in record time. Jeffrey Havard is still fighting for a second trial 11 years later. Neither one of them were treated fairly by the Injustice system.       Why you are talking about her attitude, the lawyers forgot to mention that GZ assaulted a police officer, and had a charge in a past relationship and oh by the way the dispatch told him not to follow that young man and he did anyway, the bottom line is GZ stalked and killed an unarmed young man and was giving a slap on the wrist and by the way he also received so much many for those who supported him and his lawyers hasn’t received their pay out yet…..hmmmmm something to think about.

      Exactly, they also fail to mention that when she fired the warning shot, that it was not in the air, it was towards Rico, and that his two sons and their new baby were in the same room with him, and that the bullet hit the door frame, and could have easily hit one of those kids…That’s is why she got some much time, their was children in the same room when she fired the gun, and also she was in violation of a restraining order that had been put on the both of them previously…. Both attorney’s was on Tom Joyner and Michael Baisden a while back and I heard both sides of the story from the stand point of the defense and the prosecution…. and she should get time….not 20 YEARS. She needs help, she is not the innocent person that she is trying to make herself out to be. In the court documents, they talked about how she had filed for an order of protection against Rico and then two weeks later they were at the picture place taking Christmas pictures and she then had the nerves to post them. That was some of the evidence that was used against her in her first trial. They have a history of violence between each other….And the fact that you are firing a gun, and their are little kids in the room, yes she needs to do some time and get some help….not 20 years, 10 years maybe but not 20….and she should of thought about all of this before she acted a fool….

      and fyi…. I was a battered woman, was stabbed and left for dead….so I don’t feel sorry for her….she was provoking some of the abuse….then she stupid.

      Ppl have their own way of being in a relationship and clearly she owned a legal gun that was stored at this mans home. So you need to be bruised up to be battered? Psychological and emotional abuse is sometimes worse. He has 5 baby mothers and brags about beating four of them. Having a bad attitude is not against the law. She was able to control herself and not shoot him. You must be friends with the guy or just dont know the first thing about posing an argument. Your “facts” were opinion and at the end of the day these kids are without a mother and are with a man that says he would have killed their mother.

    I’m glad she is getting another shoot and I hope this is not a “for show” trial. But what I read this to say is stand your ground will not be considered but she gets a new trial still doesn’t seen right to me. Unlike Zimmerman she was at risk from a much stronger person but instead of dropping him she fired a warning shot in the air no one died & apparently since they are still both living it served its purpose.

    I don’t know how I feel about another trial in the same backwards place. People arw getting happy and the result might be the same. I feel sorry and I hope justice will prevail. Hopefully the jury and court are a little more educated and a little less racist.

    The reason why they were so hard on her was because after that orginially happened, they let her off and was told to stay away from him, well like an idiot she started calling, texting, and going back to his home, an altercation broke out, he called the police and she was rearrested basically because the system felt like she didn’t learn her lesson the first time!     Read the whole story and listen to the 911 tapes people. It is not as cut and dry as you think. She shot at him with her children standing right next to him and they were running out of the house at the time (the husband and kids that is) when she fired at him/ them. Perhaps she had been abused, who knows…and if she was then I am sorry for her…but she went out of the area of supposed danger, left her kids in the room with the man, went out of the room, got the gun, came back onto the room, and shot at the husband right in front of her children with them standing next to him and while they all had turned to run outside. That, no matter what race you are, is self defense.

    I believe it is racism, blacks and whites are not treated equally in the judicial system. Look how many innocent young black men died at the hands of the police department. Do you ever hear of this happening to any white men (young or old)? George Zimmerman used the stand your ground law, and was quite successful; even though he had no ground to stand on. Let’s compare cases: Alexander went to her husband’s house and a domestic dispute insuied. Alexander used her pistol that was already in the house to prevent and further battery against her.     What I’ve come to realize, as an African American male that racism is real and our justice system toward African Americans is all but for us. I live less than an hour away from Sanford Florida and can remember as a young man the KKK assembled in Protest in front of our court…..what did they get?? Our tax dollars at there finest(police) security and barricades. When we(African Americans) decide to hang out amongst one another in large number’s…..what did we get?? A free ride to the county jail by our tax dollars at there finest(police), charged with unlawful assembly and ensighting a riot as well…..So, let’s sit back and see if they get this retrial right or better yet, should there be another trial period? I think our justice system is unfair to minorities and fair only to the majority…..and this is what y’all want us to pledge to?? Liberty and Justice for all?? Answer this America, who does “all” apply to?

      she didn’t shoot a gun in the air, she shot it directly at him, TWICE, while her children were standing beside him. she is using the public’s outrage of zimmerman, to help her cause. but she was in the wrong. please read the facts. not every brown soul is innocent. i am african american and my parents were panthers. i know about injustice. this was not the case. she left, got a gun, and returned. she was not in fear, she was the aggressor. she was not abused, as she had been hitting up, too. the children ran and called the cops when one of the bullets almost hit them. she – was – not – innocent.

    So what if she hadn’t stayed in the home for approx. two months. That right there shows that she had left her home, most likely due to her ex-husband’s abuse. Understand that love is an unusual emotions, which causes those in love to sometimes do things that may not make sense to others. She probably wanted her marriage to work. he excused her most likely because he had someone else and was provoking her, by questioning the paternity of the child and her loyalty to the marriage. This is done to down play his wrongness. I was married but I would not wish this on my ex, no matter what, who could sit back and watch the mother/father of their children be sentence to 20 years in prison. I mean you married a person love had to be their at one time. I can not understand how Zimmerman could prove self defense (stand your ground, which is a joke, and is a permit to go after certain people). The same prosecutors could not defend Trayvon Martin, but could prosecute this lady. I do not pretend to know the ins and outs of the law, but I know what happened to her is wrong and she should be freed to be with her children. How dare the ex-husband cooperate with the prosecutors to this extent. Being once in love with her and she is the mother of his children, he knows his part in this and he is not the dutiful father he pretends to be. He should be ashamed of himself.

      no, love, what i mean is she left that day and came back with the gun. they had been fighting. he had wounds, too. the children confirmed that she left and came back. the stand your ground law clearly states that the dangers must be imminent, meaning you have no where else to turn. if you can leave and return, then you were safe, and put yourself back in harms way.

    We live in a country where it has always been accepted to shoot, hang, drag, burn, any black person, so this is just another case that proves that when you are a person of color(BLACK) you get a different kind of justice you get ” JUST US” and unless you happen to have people that will put up a fight and bring your situation to social media then in all likelihood your story wont be told and you will just fall through the cracks, but in this case this was made public and after that killer zimmerman walked free the state of florida being once again put in the spot light, they had no choice but to grant a new trail, but even with this new trail this is not going to stop them from doing what they wont when they wont and how they wont, i will never go or spend one red cent in the state of florida and if more people would do that hit them where they understand in the pocket then laws could and would get changed in that state and all other states just like them.

    I will admit that I haven’t done the research yet but just by reading some of the reviews I offer this: Has anyone questioned WHY she went back? She had just had a baby. Was she working? Was the baby the 2nd husbands? Maybe she went there because she didn’t have a place to go or he wanted to visit with the baby. Either way, something happened. Whether he hit her or she hit him…SOMETHING sparked it. I’ve read that he accused her of infidelity. That’s possible. But REGARDLESS, she had her BABY there. I’ve known it to happen that when men get mad that they sometimes won’t LET you take the kids away. Maybe she went to the garage and tried to get away but then thought about and realized that she wasn’t going to be able to get her baby out of there WITHOUT some sort of protection for her. People get abused all the time, and there is such an issue called abuse syndrom. I guess all I’m saying is, if she did fire a gun and it could’ve hit the kids, it wasn’t DELIBERATE. Intent is 3/4 of the law isn’t it? She’s messed up it seems like, but we all have issues. 20 yrs for a “could have” is just excessive.

      no, you’re missing the key points: the day of the shooting, she left and RETURNED with a gun. she didn’t fire one shot at the ceiling, she fired TWO, directly at him, and barely missed her children. they all ran, and the children called the police cause she crazy. in truth, the husband has more right to stand his ground, than she did. please, please READ THE FACTS OF THE CASE. because of zimmerman, people are over-looking them. yes, his situation was jacked up and full of holes, but this woman, is playing on the fact that people are still angry about it to help her cause. she was wrong, and she almost killed her children in the process.

      You cant leave then come back with a gun to a house you have a restraining order saying you shouldnt be anyway and then say you were defending yourself. she lied and said she shot one time in the ceiling but the TWO gun holes were in the walls at head level.
